Remember, the IRS and all states require that you have a signed lease which clearly separates a Booth Renter from an employee in the day to day operation to keep you out of the 90% that could not pass an audit today. Having an attorney draft a lease for you could cost you thousands of dollars and, if the attorney is not familiar with the beauty industry and does not specialize in booth renting with the IRS, it probably will not contain everything you need. We specialize in the beauty industry and have helped salon owners with both IRS and state audits.

Most salon owners don't even have a business lease for their booth renters.  Without a lease, the IRS and your state would consider your renters to be employees if they were to perform an audit today. This could involve significant liability, including back taxes, penalties and interest. A very small percentage of salon owners only have a 3 to 4 page lease and think that they are protected. This is a disastrous situation; it is impossible to incorporate all three areas of a business lease in the salon and spa industry into a 3 or 4 page lease, not to mention IRS and state issues and covering business issues to protect your investment.
